Important: These Terms of Sale apply to purchases made from kaba.com.gh and KABA's authorised sales channels. Nothing in these Terms excludes any right that cannot lawfully be excluded under Ghanaian law.

Who we are

KABA and kaba.com.gh are brands of Kality Ltd, a company registered in Ghana under company number CS226722016. Your contract of sale is with Kality Ltd.

Who can buy

We currently sell and deliver within Ghana. Individuals and businesses may buy from us. You must be at least 18 years old to place an order. If you place an order for a business or another person, you confirm that you have authority to do so.

Products

We sell new consumer electronics, smart-home and security devices, networking and satellite-internet equipment, and accessories from the brands shown on our website. Unless we expressly state otherwise, products are new and not used, refurbished or pre-owned.

Some products are made for markets outside Ghana. Differences may include:

  • power plugs or adapters;
  • voltage ranges;
  • language or voice-assistant availability;
  • app-store region;
  • regulatory markings;
  • packaging.

Where a particular feature matters to you, check it before ordering, or ask us.

Products that depend on a third-party service

Some products only work fully with a service run by someone else. Examples are a satellite-internet subscription, a voice-assistant account, or a manufacturer's app or cloud service. That service is provided by its operator under its own terms, prices and availability, and is not part of your purchase from KABA.

Unless we expressly confirm it for your order, we do not guarantee that such a service is available in your location, or that it will continue to be offered.

Availability and special orders

A product shown as available does not always mean it is physically in Ghana at that moment. Stock may be held locally, incoming, available through our supply network, or specially sourced. Where a product has a longer fulfilment period, we will tell you before you pay.

When a contract is formed

A binding contract is formed when you complete payment at checkout and we send you the order confirmation.

We may still cancel an order after confirmation where:

  • the product turns out to be unavailable, or you decline the delivery quote;
  • fulfilment becomes impossible;
  • the law requires it;
  • there is a material pricing or product-information error; or
  • we reasonably suspect fraud or unauthorised payment.

If we cancel, we will tell you promptly and refund the amount you paid, in full, under these Terms and applicable law.

Prices and currency

Prices may be displayed in Ghana cedis (GHS) or, as a guide, in US dollars (USD). Payment is always taken in GHS. The GHS amount shown at checkout is the amount you pay for the products; any delivery cost is quoted and paid separately (see below).

Prices include applicable taxes (VAT and levies).

Prices may change at any time before you complete checkout. A later price change does not affect an order already confirmed.

Pricing and website errors

If a product is materially mispriced, or has a material specification, stock or information error, we are not required to fulfil the order on the incorrect terms simply because payment went through. We may offer the correct terms or cancel the order. If we cancel after receiving payment, we will refund the amount due.

Payment

Full payment is required before dispatch or collection unless we agree otherwise in writing. Payments are processed by Paystack, by card or Mobile Money, and by any other method shown at checkout.

Why your payment shows Kality Ltd. KABA is a brand of Kality Ltd. So the Paystack payment page, your Mobile Money approval prompt, receipts, SMS alerts and card or bank statements show Kality Ltd rather than KABA. This is expected: it is the same company, and your order is unaffected. If you see a charge from Kality Ltd that you do not recognise, contact hello@kaba.com.gh.

Foreign-currency cards and refunds

All payments and refunds are in GHS. If you use a foreign-currency card or account, your provider may apply its own exchange rate or charges. Where we refund the correct GHS amount, we are not responsible for losses caused solely by exchange-rate movements or third-party conversion charges, except where the law requires otherwise.

Delivery and collection

At checkout you choose one of two options:

  • Delivery (quoted after order), anywhere in Ghana;
  • Click and collect, free, from our registered office in Spintex, Accra.

For delivery, the delivery cost is not included in your order total. After you order, we contact you with the delivery cost and estimated timing, based on your location, the products and the stock position. You pay the delivery cost before dispatch, by the method we agree with you.

If you do not accept the delivery quote, you may cancel the order, or switch to Click and collect. If you cancel, we refund the full amount you paid.

Estimated timings are targets, not guaranteed deadlines, unless we expressly agree a guaranteed date. Delivery may be carried out by KABA or by a courier acting on our behalf. See the Delivery page.

Cancellations, returns and statutory rights

Completed sales are final, except where Ghanaian law, or our Returns & Refunds Policy, requires or allows one of the following:

  • cancellation;
  • return;
  • refund;
  • repair;
  • replacement;
  • another remedy.

Qualifying online consumers may have a statutory right to cancel an electronic purchase within 14 days after receiving the goods, subject to the conditions and exceptions in applicable law. Where that right applies, we will honour it.

Where no legal or expressly stated return right applies, we are not required to accept a return merely because you changed your mind, chose the wrong product or specification, or no longer want the item.

Wrong, damaged or defective products

Please inspect your order as soon as reasonably possible. If you receive the wrong item, or a product appears damaged or defective on arrival, contact us within 3 days where reasonably possible. We may ask for photos, videos, serial numbers or packaging.

This 3-day reporting request does not remove any statutory right that cannot legally be limited to that period.

Warranty

Products sold by KABA carry the manufacturer's warranty only, on the manufacturer's terms. The length and conditions vary by brand and product. KABA does not give a separate store warranty.

Installation

Buying a product does not include installation, configuration or site work unless your order says so. Where we or a partner offer installation, it is quoted and agreed separately.

Promotions and discount codes

Discount codes, newsletter offers and other promotions may carry their own conditions, including validity dates. Those conditions apply to the promotion concerned. A discount code has no cash value.

Business customers and tax documents

Businesses may buy under these Terms unless separate written terms are agreed. We can issue applicable tax invoices. Where Ghanaian tax law requires a purchasing organisation to withhold tax, the customer must comply and give us the withholding documentation or certificate.

Fraud and verification

We may carry out reasonable checks on high-value or unusual transactions. We may ask for information reasonably needed to verify the purchaser, recipient or payment method.

We may suspend, decline or cancel a transaction where we reasonably suspect any of the following:

  • fraud;
  • unauthorised payment;
  • identity abuse;
  • promotional abuse;
  • unlawful activity.

Electronic communications

We may send transaction messages by email, SMS, WhatsApp, your KABA account, or another contact method you provide. These include:

  • order confirmations;
  • receipts and invoices;
  • delivery information;
  • service messages.

Marketing messages are handled separately, under our Privacy Policy and your preferences.

Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful. To the maximum extent permitted by law, we are not responsible for losses caused solely by:

  • circumstances outside our reasonable control;
  • customer misuse;
  • incompatible third-party products or services;
  • the unavailability of a third-party service;
  • acts of third parties for whom we are not legally responsible.

For business purchases, and to the maximum extent permitted by law, we are not liable for indirect loss of profit, revenue, anticipated savings, business opportunity or business data.

Events outside our control

We are not responsible for delay or failure caused by events reasonably outside our control, for example:

  • severe weather;
  • transport or customs disruption;
  • supplier delays;
  • strikes or civil disturbance;
  • government action;
  • telecommunications outages.

We will take reasonable steps to tell you about material delays.

Complaints and disputes

Please contact hello@kaba.com.gh or +233 24 139 2599 with your order number and the details. We encourage you to give us a reasonable opportunity to investigate before formal proceedings, without affecting any legal right or remedy you have.

Governing law

These Terms and purchases from KABA are governed by the laws of the Republic of Ghana. Subject to mandatory consumer rights or procedures, unresolved disputes are subject to the jurisdiction of the courts of Ghana.

Changes to these Terms

We may update these Terms to reflect changes in our business, technology or applicable law. The version in effect when you complete checkout applies to that purchase.
